Default Law to fix unfair hiring ?

He was speaking at a one-day fair-employment conference organised by the Tripartite Alliance for Fair Employment Practices (Tafep) and the Singapore Tripartism Forum, and held at the Grand Copthorne Waterfront Hotel.

An online report by The Straits Times said that Tafep received a record number of 303 complaints last year, half of which were related to gripes by Singaporeans that their employers prefer foreigners.

While "legislation is not something to rule out altogether", Mr Tan noted that the experiences of some countries have shown that laws alone do not change employers' mindsets.

For instance, some companies might find ways to get around the system even if anti-discriminatory laws are implemented.

He said: "We should also note that having legislation is not a silver bullet that will solve all problems.

"What we want is for people to really change the way they look at things, for employers to have a more progressive mindset.

We cannot legislate changes in mindsets." Mr Tan explained that, for now, Tafep's use of a "moral-suasion approach" in tackling the issue of workplace discrimination is preferred. This is one effective way to shape employers' mindsets and encourage companies to "effect real systemic changes towards progressive and enlightened employment practices", he added.

He said: "We should aim for a balanced approach which can serve Singaporeans well in the long run.

"With or without legislation, discriminatory hiring practices have no place in Singapore."

He also said that, in the past three months, the Manpower Ministry has investigated several employment-discrimination cases.

"Where there are grounds to believe that employers have violated the tripartite guidelines, they could, and some have indeed had, their work-pass privileges curtailed," Mr Tan said.

Tafep presented its annual report yesterday, which showed that it had reached out to more employers last year and got more of them to pledge to practise fair employment.

The event brought together an international audience of over 500 participants, comprising unionists, business leaders and human- resource practitioners.

To foster ownership in preventing workplace discrimination, Mr Heng Chee How, co-chairman of Tafep, urged employers to make the Fair@Work Promise via Facebook. This demonstrates one's commitment to be fair and inclusive at the workplace.

Mr Heng, who is also deputy secretary-general of the National Trades Union Congress, added that with consistent effort, employers and employees can work together to create fair and inclusive workplaces "in the face of challenging competition, as well as changing demography".
If our Ministers really wanna help, just let EP be subject to same as WP and SP. With high levies and quota to restrict the number of EP. This will ensure also that employers choose those foreigners that are really capable and good to work in their company.

Tan Chuan-Jin work too long in army. Change employer mindset ... as good as saying change the mindset of those General in SAF. Big MNC and companies, their staff hiring not done by their CEO and it's a realistic market where "if i can get cheaper labour why not ??"

is it the one from AMK GRC. The one who daughter said get out of elite face.

If the law include cant hire own family member then the high paid politician cant hire son,uncle,in laws.

How abt those company that provide EP to their staff but paid less? A lot of this company right? That's may be one of reason why s'porean may not get the jobs? If MOM want to go in depth to check sure a lot..but

Frozen yogurt chain llaollao under investigation for turning away Singaporean from job

SINGAPORE: The Tripartite Alliance for Fair and Progressive Employment Practices (TAFEP) is looking into a case of a local Punjabi woman purportedly being turned away from a part-time job at a frozen yoghurt shop in West Mall because she could not speak Mandarin.

Ms Karish Kaur had written in a Facebook post last Wednesday (Jan 7) that an assistant manager at llaollao turned her away because she was told the manager could only speak Mandarin.

“I got turned away from a part-time job I am adequate for ... Why is it that the onus is now on me to learn a whole new language just so I am able to attain a part-time job at an F&B outlet?” she added, in the post which has since been circulated.

But the frozen yoghurt business’ country manager Edwin Ferroa told TODAY the person who had attended to Ms Kaur was actually not a staff.

“We started our investigations last Saturday and found out that the person who turned Karish away was just the wife of one of the franchise owners (of the West Mall outlet),” said Mr Ferroa. “What the wife did is totally wrong. She should have referred Karish to the franchise owners instead of turning her away.” He added that the llaollao management has issued a stern warning to all franchisees to restrict the entry of unauthorised personnel into their kitchens.

Responding to TODAY’s queries, a TAFEP spokesperson said that they were alerted to the incident through a complaint received on Monday, and started obtaining more details from the franchisee the following day.

“According to the Tripartite Guidelines on Fair Employment Practices, if a job entails proficiency in a particular language, employers should justify the need for the requirement. In this case, there was a potential contravention of the Guidelines,” the spokesperson added.

Llaollao Singapore has since issued a public apology via a Facebook post on Jan 13. “We have been in touch with Ms Kaur to understand more about the incident, and are seeking her kind understanding and patience in giving us a chance to turn her experience with (us) into a positive one.”

What happened to Ms Kaur above could happen to me also....since me also the "yellow outside, white inside", sigh...
